Terms & Conditions

1) General Info

All orders that are accepted and goods supplied are subject to the following express terms and conditions of Loginandbuy whose registered office is at Kingsbury nw9 8ua, registered in England & Wales, Company Reg No 0998879, VAT No 985678567.

NOTE: The following terms are liable to change without notice to you in relation to future sales.

2) Order Cancellations, Returns, & Refunds

a. Phone notification isn’t sufficient. To cancel an item, you MUST let us know via a written letter, fax, or email (support@loginandbuy) and clearly addressed to: Customer Services. Login and Buy, Oasis Church Lane, Kingsbury, London, NW9 8UA.

b. You may cancel your order from the moment of purchase up until the day before dispatch. If cancelled within this time frame, you’ll receive a full refund via the original method of payment.

c. Consumers have up to 14 days from the date of delivery to return, exchange, or refund any unwanted item(s). Items should be in brand-new condition and are at the discretion of Login and Buy (accepted items may be subject to a diminished value charge.

If accepted, you will receive a full refund of the item’s cost and our least expensive delivery option. To return an item, please see 4(a) above.

d. The buyer is obliged to care for the product while in their possession so the item(s) may be sold again by Login and Buy. The Company will claim, from the Buyer, for the resulting loss in value for goods not kept in a reasonable condition. The Buyer must make the goods freely available at the original delivery address, to the Seller or his agent, within 21 days of cancellation, for collection on a working day. The regulations do not apply to unsealed licensed software. If all requirements are met and the item is faulty, we will give you a refund for the cost of the product plus the delivery charge to the value of our least expensive delivery option and less any collection charges agreed upon and confirmed with login and buy to arrange the return on your behalf.

e. All packaging material MUST be retained and kept in reasonable condition until the good(s) are fully tested and functional. Items MUST be returned to Login and Buy in their original condition with all extra components (such as memory cards, leads, manuals, etc.)

f. Customers should retain the proof of dispatch until Login and Buy acknowledge safe receipt of the item(s).

g. DISCLAIMER: If returning an unwanted item, you are eligible to pay for shipping. If item(s) are diminished while in transit, you are responsible for the cost.

If any of the above requirements aren’t met, Login and Buy reserves the right to reject any refunds/cancellations/exchanges/returns.

3) Warranty Information & Returns

a. Buyers receive the benefit and security of a 12-month manufacturer repair warranty (starting from the date of purchase.)

b. If your item(s) develop any defects covered by the manufacturer repair warranty, please notify us via email (support@loginandbuy) or phone call (0208204 1334). You’ll be promptly advised by our customer support team.

If returned, please mark your package with the Returns Authorisation Number (RAM) provided.

c. Unwanted item(s) returned within 14 days of delivery are subject to a diminished value charge.

Software items will not be accepted for return unless the goods are faulty or misdescribed or the shrink-wrap or copyright seal is intact. Items returned as faulty but found to have no fault (tested by the manufacturer) may incur a testing charge, the value of which will be based on the cost to the Company without profit.

d. Customers should retain the proof of dispatch until Login and Buy acknowledge safe receipt of the item(s).

e. All packaging material MUST be retained and kept in reasonable condition until the good(s) are fully tested and functional. Items MUST be returned to Login and Buy in their original condition with all extra components (such as memory cards, leads, manuals, etc.)

4) Descriptions & Prices

a. Login and Buy’s website shows all up-to-date prices and product descriptions. Login and Buy’s prices are subject to change, though your purchase remains the same value at which you paid.

b. You MUST verify a product(s) suitability and compatibility before purchasing. Goods ARE NOT supplied on a trial basis and refunds/returns may be rejected.

c. All samples, images, drawings, descriptive matter, specifications and advertising issued by the Seller and any descriptions or illustrations contained in the Seller’s website are issued or published for the sole purpose of giving an approximate idea of the products described in them. They shall not form part of the Contract which is not a sale by sample.

5) Delivery & Shortages

a. Every order may be subject to delivery charges.

b. Unless proof is provided, Login and Buy may only deliver the item(s) to the address specified on the credit/debit card used for purchase.

c. If Login and Buy fail to deliver on time or alter their delivery dates, the buyer has the right to cancel the order and receive a full refund.

d. If the buyer misses the agreed delivery date & time, they may be subject to additional delivery charges. Login and Buy are not held by contract to deliver on any specified date or time, nor are they responsible for any loss or damage that occurs via a reasonable or unavoidable delay in delivery.

e. The buyer should inspect the item(s) and packaging before accepting the delivery or signing the delivery note. If goods or packaging are damaged, DO NOT accept the delivery.

6) Loss of Good(s)

Login and Buy are liable to the value of the goods and nothing more. Should the buyer somehow suffer any further losses, Login and Buy hold no legal responsibility.

7) Data Protection

Login and Buy do all they can to secure their customer’s information and, unless negligent, they are not liable for unauthorised access to information supplied by you.

Login and Buy use a single registration page and only ask for the bare minimum information required to process an order and payment. Login and Buy do not sell any information provided.

We are registered under the Data Protection Act to hold personal electronic data; this requires us to use certain security procedures, which should safeguard the data. As regards interception during transmission to us, please see our section on Security.

Distribution Partners

These partners undergo thorough security checks. They withhold the bare minimum required to process a buyer’s order and dispatch the good(s).

Delivery Partners

Login and Buy will share the bare minimum information in order to provide a secure and fast delivery.

IT Companies

Login and Buy works with companies that support their website capabilities, security, and other business systems.

Marketing Companies

Login and Buy partner with marketing companies to provide buyers with the most relevant communications (emails, texts, letters, etc.)

Payment Processing

In order to take payments, Login and Buy works with the most secure third-party payment processing companies.

Fraud Prevention Services

To shield buyers from fraud, Login and Buy make checks before accepting or processing an order. To do this, Login and Buy may require proof of address, identification, etc.

This information will be used for the sole purpose of preventing fraud and money laundering.

An example of required personal data would be: name, address, date of birth, IP address, vehicle details, etc.

If needed to prevent or investigate a crime, Login and Buy may share your details with law enforcement.

Login and Buy do this to protect both themselves and their buyers from digital crime, fraud, money laundering, etc.

We process your personal data on the basis that it is necessary in the public interest or in exercising official authority for us to prevent fraud and money laundering, and to verify identity, in order to protect ourselves and to comply with laws that apply to us.

If seen as a potential threat, fraud prevention agencies may hold personal data for up to six years.

8) Governing Law

Unless otherwise agreed in writing, the laws of the United Kingdom govern this contract.

BUSINESS CUSTOMERS – THE FOLLOWING TERMS ALSO APPLY.

Any topics covered above will be overwritten by the terms given below.

9) Credit & Settlement Terms:

a. To create a credit account, customers are required to complete an application form. To receive this form, email Login and Buy via suppoer@loginandbuy

Governing bodies wanting goods will be required to furnish an official order.

b. Where credit terms are allowed, terms of payment are strictly net and payable 30 days from the date of the Company’s invoice. Login and Buy reserve the right to add charges to accounts with unpaid terms of over 30 days.

If payment dues remain, buyers may be subject to a surcharge of 5% of the item(s) value if the payment is outstanding for over 60 days.

Outstanding payments will be required to pay 2% interest every month until payments are made.

NOTE: The above policies start from the day a buyer receives an invoice from Login and Buy.

10) Cancellation:

Phone notification isn’t sufficient. To cancel an item, you MUST let us know via a written letter, fax, or email (support@loginandbuy) and clearly addressed to: Customer Services. Login and Buy, Oasis Church Lane, Kingsbury, London, NW9 8UA.

Login and Buy reserve the right to reject any cancellation that fails to meet their terms. If acquiring the cancelled order is a considerable challenge, the buyer may be subject to a cancellation charge.

11) Warranty & Returns

a. The consumer contract regulations (stated in section 3 above) do not apply to business purchases.

b. Login and Buy MUST be notified of any failures or difficulties MUST within three working days of delivery.

c. Under Login and Buy’s discretion, they may pay any warranty repair charges within the UK Mainland for up to 10 days from the date of purchase.

The buyer will be liable for any carriage charges for warranty repairs made after 10 days of purchase.

d. If ‘On Site Warranty’ is offered, it is up to the buyer to contact the manufacturers to obtain said services. Login and Buy ARE NOT responsible for the manufacturer’s failures or services.

e. The company may reject warranty claims due to: fair wear and tear, accidental damage, alterations, third-party repairs, abnormal working conditions, misuse, or failure to follow manufacturer instructions.

f. The customer is responsible for any and all carriage charges for non-UK Mainland claims.

g. In the event of a dispute, the buyer will not receive a refund of carriage charge payments.

h. The return of unwanted item(s) lay at Login and Buy’s discretion. If accepted, the buyer may be subject to a restocking charge of 25% or more (minimum of £25) of the purchase value.

Software items will not be accepted for return unless the goods are faulty or misdescribed or the shrink-wrap or copyright seal is intact. Items returned as faulty but found to have no fault (tested by the manufacturer) may incur a testing charge, the value of which will be based on the cost to the Company without profit.

12) Title to Goods

Until Login and Buy receive the full agreed payment, the following remain true:

a. Until payment is fully covered, Login and Buy retain ownership of the good(s) received by the buyer.

b. If the buyer fails to pay for the received good(s), Login and Buy may legally enter any land or property, whether by themselves or on their behalf, to retake possession of any unpaid good(s).

13) Bankruptcy

Under the event of bankruptcy or a breach of contract, Login and Buy may suspend all further deliveries until amended.

14) Compatibility

Aside from pre-loaded software, all software product(s) supplied are subject to the Manufacturer’s Licensing Agreement that the seal MUST NOT be broken if you do not accept the conditions of the delivered good(s).
